General Terms and Conditions (GTC) for YouW products

1. Scope and provider
1.1 These General Terms and Conditions (GTC) apply to all contracts between Michael Maibach / YouW (hereinafter referred to as “Provider”) and the customer regarding participation in online courses and the use of digital content provided via the platform systeme.io.
1.2 Customers within the meaning of these GTC can be both consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for private purposes. An entrepreneur is any natural or legal person who acts in the exercise of their commercial or independent professional activity.
1.3 Age restrictions apply: YouW only accepts customers over the age of 18. Although the content of our products and services is not shocking, we prefer to target a mature audience that is able to understand the implications and responsibilities of the business world.

2. Description of services
2.1 The provider offers online courses for creative and conceptual fashion design. These include video lessons, exercise sheets, design tasks, community access, and bonus materials.
2.2 The services do not include state-recognized training, a guarantee of success, or legal or economic advice. The certificate issued attests to creative progress but does not constitute an official qualification.
2.3 The provider does not guarantee any specific learning outcomes. These depend on the commitment of the customer.

3. Conclusion of contract and access
3.1 The presentation of the services on the website does not constitute a legally binding offer. A contract is concluded as soon as the customer completes the purchase and receives a confirmation by email.
3.2 Access to the course will be granted via the systeme.io platform after receipt of payment. The access data is personal and may not be passed on to third parties.

4. Trial period & access restriction
4.1 After conclusion of the contract, the customer will receive a 14-day trial period. During this period, only lessons 1 to 10 will be accessible. Further content will be unlocked from day 15.
4.2 If the contract is canceled within the trial period, the purchase price will be refunded in full. After the trial period has expired, there is no longer a right of withdrawal.

5. Prices and payment terms
5.1 All prices are total prices including statutory value added tax and are in US dollars.
5.2 The price of the items may be changed at any time. However, the price applicable to an order is the price announced at the time of the order. The price stated at the actual time of the order is decisive.
5.3 Payment is made via the payment service providers offered on the website (e.g., Stripe, PayPal).
5.4 For payments from abroad, additional bank charges may apply, which are to be borne by the customer.
5.5 Secure online payment by credit card is provided by Stripe. The information transmitted is encrypted using state-of-the-art software and cannot be read during transmission over the network. Any guarantee for the security of this system is the sole responsibility of Stripe and cannot be attributed to us.

6. Right of withdrawal for consumers
6.1 Consumers have a statutory right of withdrawal of 14 days. The withdrawal policy can be viewed during the ordering process.
6.2 Entrepreneurs are not entitled to a statutory right of withdrawal.

7. Rights of use and copyright
7.1 Upon conclusion of the contract, the customer receives a simple, non-transferable right of use to the content provided for their own purposes.
7.2 It is prohibited to reproduce, distribute, make publicly available, or sell the content. Written consent is required for any distribution.

8. Certificate issuance
8.1 A certificate may be issued after voluntary submission of a paper and feedback from the course instructor.
8.2 The certificate is not recognized by the state and serves to confirm creative achievement.

9. Liability
9.1 The provider is liable without limitation in cases of intent or gross negligence as well as for physical injury or damage to health.
9.2 In cases of slightly negligent breach of essential contractual obligations, liability is limited to the typical foreseeable damage.
9.3 No liability is accepted for indirect damage, loss of profit or downtime of the platform.

10. Data protection
10.1 The collection and processing of personal data is carried out in accordance with the GDPR. The privacy policy is available on the website.
10.2 In accordance with the Data Protection Act, you have the right to access and correct your personal data. By complying with these general terms and conditions of sale, you confirm that you have read our privacy policy and consent to our collection and use of this data.
10.3 If you enter your email address on one of our network sites, you will receive emails with information and/or promotional offers about products published by YouW or other partners. You can unsubscribe at any time. All you have to do is click on the link at the end of our emails.

11. Final provisions
11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 If the customer is an entrepreneur, the exclusive place of jurisdiction is Reutlingen. Consumers residing outside the EU retain their statutory protection.
11.3 Should individual provisions be invalid, the remainder of the contract shall remain valid.

5. Use of Systeme.io

I use Systeme.io as a course platform and technical infrastructure. The data is stored and processed there.

Systeme.io is based in Ireland and France and is subject to the GDPR. A data processing agreement (DPA) is in place.

6. Storage period

I only store personal data for as long as it is necessary to fulfill the respective purposes or as long as there are legal storage obligations (e.g., 10 years for tax purposes).

7. Disclosure to third parties

Data will only be disclosed to third parties if this is necessary for the fulfillment of the contract (e.g., payment providers such as Stripe/PayPal) or if you have expressly consented to this.

8. International transfer

As my offer is also available internationally (e.g., outside the EU), data may be transferred to third countries. I ensure that appropriate protective measures are taken, in particular by using providers with GDPR-compliant standard contractual clauses.

10. Cookies, tracking, Newsletter and direct advertising

Cookies and tracking

Cookies are used when you visit our website (e.g., via Systeme.io). You will be asked for your consent on your first visit. We only use essential cookies and, based on your consent, cookies for analysis and marketing purposes.

Use of Meta Pixel (Facebook Pixel)

Our website uses the so-called Meta Pixel (formerly Facebook Pixel) of the social network Facebook, provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.

With the help of the pixel, we can place targeted interest-based advertising on Facebook and Instagram (“Facebook Ads”). The pixel also enables us to measure the effectiveness of these ads (“conversion tracking”) by recognizing whether users were redirected to our website after clicking on an ad.

Newsletter and email communication

If you subscribe to our newsletter, we will use the data you provide (e.g., name, email address) exclusively to send you content and information about our services. You can unsubscribe at any time via a link in every email.

After registering, you will receive a confirmation email with a link for verification (double opt-in). Only then will you be added to our mailing list.

Legal basis: Processing is based on your consent in accordance with Art. 6 (1) (a) GDPR.

WhatsApp communication

If you voluntarily provide us with your telephone number, e.g. via a form or when registering for the newsletter, and agree to be contacted via WhatsApp, we will use your data for direct communication, notifications or personal enquiries via the WhatsApp Business service (provider: WhatsApp Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland).

Participants who submit a final project will receive a non-state-recognized certificate if their performance is satisfactory. This is voluntary, based on individual assessment, and does not constitute a legal claim to success or qualification in a professional sense.
